Legal Framework

·  44th Amendment Act, 1978 of the Constitution of India eliminated the right to acquire, hold and dispose of property as a fundamental right. Earlier, right to property was a fundamental right under Article 19 of the Constitution of India.

 

·  Article 300 (A) of the Constitution of India was inserted in 1978 to affirm that no person shall be deprived of his property, saved by authority of law. The result is that the right to property as a fundamental right is now substituted as a statutory right.
