Legal Framework

·  Articles 102 and 197 of the Constitution of India specify three kinds of disqualification for being chosen as member of either House of Parliament or State legislature on account of a declaration or order passed by a competent court. They are (1) if he is of an unsound mind and stands so declared by a competent court, (2) if he is an undischarged insolvent, (3) if he is so declared by or under any law made by Parliament.


·  Representation of Peoples Act, 1951, lays down the principles and provisions governing the conduct of elections in India and the disqualifications of candidates unfit to contest elections.
