Legal Framework

·  Hindu Succession (Amendment) Act, 2005 was enacted by the Parliament and came into force on 9th September, 2005. It replaced the earlier Hindu Succession Act of 1956. The new Act gave the many rights to daughters with respect to their ancestral property. The Hindu Succession Act, 1956 introduced many reforms and it abolished completely the essential principle that runs through the estate inherited by a female heir, that she takes only a limited estate.

 

·  The Muslim Women (Protection of Rights on Divorce) Act 1986 was passed as a result of the Shah Bano case. The new Act stated that the Muslim husband is liable to pay alimony only during iddat (the span of 3 months after the divorce). It also stated that if a divorced woman has no relatives to take care of her or she has no way to take care of herself, the magistrate has to order the State Waqf Board to provide support to the woman and her children.
