Landmark Judgments

·  Indian Medical Association Vs. V. P. Shantha and others, 1995 is a landmark judgment in the history of consumer rights in India as it brought medical profession within the purview of consumer protection act. The case made medical negligence by doctors and hospitals a ground for filing a consumer complaint by the patient. Now all private hospitals and private clinics can be sued for medical negligence.


·  V. P. Somasekhar Case, 1999 is another landmark case that held that “Parallel proceedings under the Civil Procedure Code of 1908 on the same ground is prohibited when the matter is pending before the consumer court”.
