Landmark Judgments

·  Mohini Jain (Ms) Vs. State of Karnataka, 1992 is a landmark case in the history of Right to Education. It was in this case that the Supreme Court of India established for the first time that education is a fundamental right. It observed that the Article 21, of the Constitution of India, guarantees the right to life, which includes the right to live with dignity. The court also secured the right of every citizen to have access to free and compulsory education.

 

·  Also, in the case of Unnikrishnan Vs. State of Andhra Pradesh (1993), Supreme Courtruled that the right to education is a fundamental right that flows from the Right to life in Article 21 of the Constitution. This further strengthened the demand of making right to education a separate fundamental right in the Constitution of India.
