Legal Framework

•  Article 41 of the Constitution of India states that: “The State shall, within the limits of economic capacity and development, make effective provision for securing the right to work, to education and to public assistance in cases of unemployment, old age, sickness and disablement, and in other cases of undeserved want”.


•  Article 46 of the Constitution of India states that: “The State shall promote with special care the educational and economic interests of the weaker sections of the people…..and shall protect them from social injustice and all forms of exploitation”.


•  Maintenance of Parents and Senior Citizens Act, 2007 was passed by the Parliament of India to protect the interests of parents and senior citizens in the country who were not in a position to maintain themselves. It sought to empower senior citizens to claim maintenance from their children legally. It puts an obligation on the children to maintain their parents in their advanced age.
