Landmark Judgments

A.K. Gopalan Vs. State of Madras, 1950 was the first case that interpreted the scope and meaning of Right to life and personal liberty. It defined personal liberty as liberty of the physical body, that is freedom from arrest and detention without authority of law. However, in Maneka Gandhi Vs. Union of India, 1978 the Supreme Court overruled Gopalan’s case and widened the scope of the words ‘personal liberty’ considerably. It is a landmark judgment for right to life as it gave protection against arbitrary legislative action along with executive action with respect to right to life and personal liberty.
